Probate Litigation
Even with the most careful planning, disputes can arise over the administration of a decedent’s estate or management of estate assets. We regularly provide legal representation to parties in a wide variety of situations, including:
- Disputes over the validity of a Will, including claims of undue influence and lack of capacity.
- Allegations involving breach of fiduciary duty, including failure to produce an estate inventory or accounting of assets; mismanagement, misappropriation or theft of estate assets; and claims involving conflict of interest or self-dealing.
- Questions arising over the decedent’s ownership interest in any asset, including business interests and interests acquired pursuant to Washington’s Community Property laws.
- Actions brought by an estate to collect money owed the decedent, and actions brought against an estate by a creditor.
In most cases, the law severely limits the time in which a claim involving a decedent’s estate must be brought. Once a claim is brought, the Washington Trusts and Estates Dispute Resolution Act provides a variety of options for resolving it, including mediation, binding arbitration, as well as a traditional court trial.
